Padres Giveaway
NO PURCHASE IS NECESSARY
TERM: October, 2009
Prize – Field Level Tickets Behind Home Plate @ Selected Home Game(s)
ODDS OF WINNING: Odds of winning will be determined by the number of entries received.—Winners will be responsible for their own transportation, and overall accommodations. Holiday Wine Cellar will only be supplying the game tickets for the winners of the Padres Giveaway.
HOW TO PARTICIPATE IN THIS CONTEST:
1. (a) Signing up for the contest online. If you signed up for the contest on www.holidaywinecellar.com via making a purchase, or adding yourself to our constant contact email list, then you are automatically entered into the Padres Giveaway.
2. Any purchase of $50.00 or more in merchandise IN- STORE.
3. Even if they do not purchase $50.00 worth or merchandise, but rather request to be entered
5. By mail. You may also enter by hand by printing your complete name, address, e-mail address, age, and the Padres Giveaway on a 3" x 5" piece of paper. Mechanically reproduced entries are not permitted. Mail your entry to: Padres Giveaway—Holiday Wine Cellar, 302 W. Mission Ave, Escondido, CA 92025. You may mail as many entries as you wish, but only one entry may be included in each outer mailing envelope. Mail entries must be postmarked by [5/04/09] and received no later than [5/06/09]. Hand-delivered entries will not be accepted and if left at our office will not be entered in the Padres Giveaway.
(a) Signing up as a registered Holiday Wine Cellar user. If you signed up as a registered user of www.holidaywinecellar.com you are not automatically entered into the Padres Giveaway - you must register, and that is done by sending an email to info@holidaywinecellar.com.
(b) Holiday Wine Cellar is not responsible for errors, omissions, interruptions, deletions, defects in part or whole, delays in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for any technical or non-technical network, telephonic, electronic, computer, hardware or software malfunctions of any kind, or inaccurate or partial transmission of or failure to receive entry information by Holiday Wine Cellar on account of technical problems or traffic congestion on the Internet, at any web site or any combination thereof.
(c) Holiday Wine Cellar is not responsible for any injury or damage to entrant's or any other person's computer related to or resulting from playing or downloading any materials in the Padres Giveaway, or for mail-in entries that are lost, late, misdirected, damaged, incomplete, altered, illegible or postage-due. All entries become Holiday Wine Cellar's property and will not be returned.
(d) Holiday Wine Cellar reserves the right to cancel temporarily or permanently the electronic method of Padres Giveaway entries if it becomes technically corrupted.
DISQUALIFICATION: All of your entries in this and all other contests sponsored by Holiday Wine Cellar in the past, present, or future, will be automatically disqualified without notice or recourse if you promote the Contest through unsolicited commercial Email, multiple repetitive postings to UseNet Newsgroups or even one posting to inappropriate UseNet Newsgroups or any other violation of Acceptable Use Policy. Any violation of such Acceptable Use Policy will prevent you from entering any future contest sponsored by Holiday Wine Cellar and we will automatically revoke your membership in Holiday Wine Cellar's web site.
All of your entries will be disqualified, at the sole discretion of Holiday Wine Cellar, if you attempt (i) to enter the Padres Giveaway through any means other than as described in these Official Rules; or (ii) to disrupt the Padres Giveaway, circumvent the terms and conditions of these Official Rules, or in any way tamper with the Padres Giveaway. If either of the above occurs, Holiday Wine Cellar has the right to remedy any such action, disruption, or circumvention, and to seek damages from you to the fullest extent permitted by law.
ELIGIBILITY: All legal U.S. residents residing in the 50 United States and the District of Columbia who are 21 years or older at the closing date of the Padres Giveaway may participate in this Padres Giveaway, or if you are under 21 years of age, you must have parental/guardian consent to enter the contest. By entering this Padres Giveaway you represent to Holiday Wine Cellar that you are either at least 21 years of age or have consent from a parent/guardian. Employees of Holiday Wine Cellar and its immediate families and members of their households are not eligible to participate in this Padres Giveaway. By registering to win the prize, the winner grants Holiday Wine Cellar permission to use his/her name (including screen name) and likeness for advertising and future promotion purposes without additional compensation (except where prohibited by law). Unaccepted prizes may not be awarded. This Padres Giveaway is subject to these complete and Official Rules.
SELECTION OF WINNERS. Winners will be selected in an electronically randomized manner on the afternoon of May 6th, 2009 for the Padres Giveaway. The winner will be notified at the day of the drawing, and has 24 hours to contact Holiday Wine Cellar regarding their prize. Holiday Wine Cellar reserves the right to modify scheduling of the Padres Giveaway without prior notice. If the judges determine in their sole discretion that there is any suspected or actual electronic tampering with the giveaway or if technical difficulties compromise the integrity of the giveaway, the judges reserve the right to void the entries at issue, and/or terminate the giveaway and conduct a random drawing to award prizes using all eligible entries received as of the termination date. Limit one prize per person. Winners may be required to sign and return an affidavit of eligibility within 3 days of notification attempt. Failure to return the affidavit in the time noted will result in disqualification of the entry and the random selection of an alternate winner. Holiday Wine Cellar may require winners to provide proof that they are the authorized account holders of the e-mail addresses used to enter the Padres Giveaway. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet service provider, online service provider, or organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the e-mail address. Any winner who does not comply with the Official Rules will be disqualified and an alternate winner will be selected. Return of any prize or prize notification as "undeliverable" will result in disqualification and an alternate winner will be selected.
NOTIFICATION:
Ticket winners will be notified at least 2 days in advance of the game. Winners will have 24 hours to respond to the Holiday Wine Cellar employee that contacts them, before another winner is selected. This process will be repeated until a winner is confirmed.
Prizewinners will be notified by e-mail sent to the e-mail address on the Holiday Wine Cellar account (or the e-mail address on the mail-in entry when applicable), and Holiday Wine Cellar is under no obligation to notify winners by any means other than e-mail. If a winner's Holiday Wine Cellar profile is no longer active, notification will be sent to the last known e-mail address.
If a prizewinner entered by mail, the notification will be sent to the address that was printed on the 3"x 5" piece of paper. Holiday Wine Cellar is not responsible for notifications that are misdirected or not received because of e-mail addresses or mailing addresses that are no longer correct. If a potential winner cannot be reached after a reasonable effort has been made during 1 business day from the first notification attempt, such person may be disqualified, with an alternate winner selected. Any prize notification or prize returned as undeliverable will result in the awarding of that prize to an alternate winner.
REDEMPTION: Holiday Wine Cellar will be the location in which the winners are expected to come and collect All Prizes. Prizes are non-transferable and no substitutions or cash equivalents are allowed except by Holiday Wine Cellar, who also reserves the right to award a prize of equal or greater value if the advertised prize is unavailable.
CONDITIONS: By participating in the Padres Giveaway, you agree to release and hold Holiday Wine Cellar and its directors, officers, employees and agents, and all prize suppliers harmless from any and all losses, damages, rights, claims, and actions of any kind in connection with the Padres Giveaway or any product purchased, or resulting from acceptance, possession, use or misuse of any prize, including, without limitation, personal injuries, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy, whether suffered by you or a third party. This Padres Giveaway is void wherever prohibited or restricted by law and is subject to all applicable federal, state and local laws and regulations. By participating, entrants agree to be bound by these Official Rules and the decisions of Holiday Wine Cellar and waive any right to claim ambiguity in the Padres Giveaway or these Official Rules. All decisions regarding the Padres Giveaway, including, but not limited to, selecting winners, will be made by Holiday Wine Cellar, whose decisions shall be final. Winners are solely responsible for all applicable federal, state and local taxes.
